Debt Settlement America recognizes the sensitive nature of your personal financial information as well as your current position. We want to protect your privacy at all times. To this end, we want you to understand the information we will collect about you and how we use this information. Accordingly, we have prepared this document which explains the Debt Settlement America privacy policy relative to our client accounts. This policy is applicable to all accounts serviced by Debt Settlement America and applies to all consumers who are customers or former customers.

What information we collect

In serving your needs, it is important to have accurate information about you. Therefore, when you apply for our program we collect information from you. The type of information requested varies based on the service you have requested and may include information such as your name, address. social security number, income, expenses. assets and employment history. We receive this information from you on our Free Consultation Form and on our Program Application Form. If we need to know about your credit history , we also receive information from third parties such as credit reporting agencies or other creditors. In addition, we collect and maintain information about your transactions with our affiliates, others, and us. This information includes account balances, payment history, credit card usage, and parties to transactions. In this policy, we refer to this information as "private information".

How we use this information

We will not disclose your private information, as described above, to any organization, affiliated or non-affiliated, unless this disclosure:

  1. is necessary to effect, administer, or enforce a transaction, service, or inquiry you have initiated. For example, we occasionally enter into agreements with companies whose expertise is necessary to provide the service you have requested. They include specialized firms for check printing, to execute security transactions as well as provide data processing services;
  2. is necessary to perform marketing or analysis services on our behalf, so that we may better understand your financial needs and determine how we can help you meet those needs;
  3. is necessary to facilitate or consummate our business transactions with third parties that work for us which does not include the selling of information for the purpose of further solicitation.
  4. is necessary to offer you debt settlement service options that Debt Settlement America is unable to provide you due to state of residency restrictions, inability to qualify for our programs due to hardship or fee structures, and other legal or non-legal limitations set forth by the respective states. This will only occur when we have established joint marketing agreements in place with another company.
  5. when required or permitted by law.

As we stated in our pledge to you, we do not share information with outside companies for the purpose of selling their products and services except we may refer you to another debt settlement or debt management provider when we cannot service you due to state of residency restrictions, inability to qualify for our programs due to hardship or fee structures, or other disqualifying reasons. DSA is not responsible for the information practices of our business partners. The collection, use, and disclosure of information by these other companies are subject to their respective privacy policies and the, which may differ from DSA's policy. Our business partners may contact you by telephone, email, or regular mail based on the information you provided to us. If one of our partners contacts you by telephone and you wish not to be contacted again by that business partner with respect to your inquiry, then you should specifically make a request to that partner not to contact you again.

Keeping your information private

We take steps to safeguard customer information. We maintain physical, electronic, and procedural safeguards that comply with federal standards to guard your customer information against unauthorized access. Our employees are bound by a confidentiality agreement and by company policy to maintain the privacy of your information. We also take appropriate corrective action when needed to enforce employee compliance with our procedures with respect to the privacy of client information. We may also ask you for personal information in order to verify your identity when you request assistance from us.

As previously mentioned, if we work with other companies who provide services on our behalf or in the case of jointly offered products, we will maintain contracts with our partners which will require them to comply with our Privacy Policy and to keep this information secure and confidential.

Privacy online

Our system safeguards include the use of encryption to protect the confidentiality of data that you transmit to us over the Internet.
